Andrew Kantor is a writer, a reporter, and a researcher who writes frequently for USA Today and who produces a blog on a number of subjects. Among other things he has produced a five page document titled "Legal Rights of Photographers" which gives an extensive review of the rights of photographers as to when and where they can take pictures. He also covers when photographers can publish the images they have taken. Basicly "If you can be there, you can take pictures there: streets, malls, parking lots, office buildings. As an advocate of the right to take photographs in public places, Mr. Krages prepared "The Photographer's Right", a flyer to educate photographers about their rights. It can be downloaded as a PDF file by clicking here. It may be downloaded and printed out using Adobe Acrobat Reader. "In brief, a model release is a document that stipulates the terms under which one party may use pictures taken of another party (or of the property owned by that other party). There is no government mandate about when a release is required. It is strictly a matter of civil law that stipulates rights that people have, both as subjects of photographs, and as users of photographs."
